An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
Definition of the requirement:
The National Research Council of Canada (NRC) is undertaking a project to extend previously licensed but under leveraged SAP integrated talent management functionality including Employee and Manager Self-Service, Recruiting, OnBoarding, Performance and Goals and Learning. In order to proceed with this extension the NRC has the following requirements:
a) A vendor hosted talent management solution that is fully integrated across all talent management functions and which offers secure, fully defined productized integrations and pre-set integration (workflow, security, messaging and data integration) with NRC’s on-premise SAP ERP HCM backend so as to optimize NRC’s HR data integrity to support improved decisions and actions. In the event of disruption or failure of a productized integration, SAP takes on the responsibility of addressing the problems. SAP’s investment in integration will save NRC the costs of building and maintaining integrations. For this particular requirement, SAP is the named exclusive agent.
b) An on-going software maintenance and support service for the talent management solution provided by SAP. The required support service provides software updates, patches and upgrades and general product support for the total solution: SAP cloud talent management solution, the current on-premise SAP solution and the productized integrations. For this particular requirement, SAP is the named exclusive agent.

Sole Source Justification for the Pre-Identified Supplier:
The NRC has licensed SAP HCM since 1999 but has only used a portion of its embedded functionality. The NRC is undertaking a project that will leverage its investment in SAP by expanding its use of available SAP solution extensions in support of additional HR requirements and functionality. This undertaking to leverage its investment in SAP HR will require a subscription to self-service integrated talent management functions in order to accommodate these changes.
The project will leverage new internet-based integrated talent management functionality including recruiting, onboarding, performance and goal management and learning management which are available to managers, employees and HR professionals via the existing SAP HR self-service portal. The subscription purchase will enable the NRC to leverage its investment in SAP on-premise HR and enable the organization to attract and maintain key talent across the NRC. A subscription model can also be terminated after the initial contract period. This provides flexibility to NRC in the event that in the future a consolidated Government of Canada solution can meet NRC’s business requirements.
The NRC competitively procured and implemented SAP, an enterprise resource planning software solution in 1999. Through the contract, NRC licensed the right to use this software solution to meet its corporate business finance, materiel, human resource and reporting requirements while title and intellectual property rights to the software remained with the vendor SAP. In this context, SAP holds the sole rights to the software solution and as such is the only provider of fixes to software bugs and enhancements to the functionality of the solution.
The NRC has over the past 16 years implemented and deployed many enhancements to the ERP solution, freely available through our support agreement, that meet the operational and strategic business requirements of many NRC business process owners. As a result of the experience gained from continued enhancements and new project deployments, the NRC and its SAP support team continue to benefit from both software fixes and the new functionality provided through upgrades and enhancements.
The option to explore a different software solution that would meet the NRC HR needs for Employee and Manager Self-Service, Recruiting, OnBoarding, Performance and Goals Management and Learning Management would be prohibitively expensive given the cost of competitive software solutions. Additionally, the cost to re-implement solutions already deployed to the NRC user community would be far in excess of this contract value.
