. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government’s intention to award a contract for these services to
Société de Contrôle Johnson S.E.C., 765 avenue Godin, Québec, QC, G1M 2W8 . Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.
If other potential suppliers submit a statement of capabilities during the 15 calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.
BACKGROUND
The department,
the Aluminium Technology Centre (ATC), Saguenay site of the National Research Council of Canada (NRC) , wishes to fill the following need : to renew the Building automation service contract of the Johnson Controls Metasys System. The contract consists in verifying the proper operation of the Metasys control system and the HVAC systems it controls, and in adjusting the equipment and programming of the system itself. (SOW annexed).
MINIMUM ESSENTIAL REQUIREMENTS
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements
Knowledge and understanding of Metasys System Control.
Professional designation, accreditation, and/or certification : Must be performed by SCJC technicians and/or authorized SCJC representatives.
THE ABORIGINAL BUSINESS PROCUREMENT STRATEGY OR ONE OF THE COMPREHENSIVE LAND CLAIM AGREEMENTS.

EXCLUSIONS AND/OR REASONS FOR USING LIMITED TENDERING
The following exclusions and/or reasons for limited tendering are invoked under
Agreement on Internal Trade (AIT) - Article(s) 506, paragraph 12, b
NAFTA / CUSMA Article 1016.2(b) - where, because of the nature of the work of art or for reasons related to the protection of patents, copyrights or other proprietary rights or proprietary information, or in the absence of competition for technical reasons, the products or services can only be supplied by a particular supplier and there is no reasonably satisfactory alternative or substitute product or service available
JUSTIFICATION FOR THE PRE-SELECTED SUPPLIER
The NRC Saguenay site, ATC will use the services of the selected supplier (SCJC) for the mentioned needs. SCJC is the sole manufacturer and supplier of the parts and software required for the maintenance and repair of the Metasys system at the ATC.
INTELLECTUAL PROPERTY RIGHTS
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
SCJC has the exclusive rights for the intellectual property on the equipment and on the software required to operate and maintain it.
PROPOSED CONTRACT PERIOD OR DELIVERY DATE
PERIOD: From December 15, 2020 to December 14, 2021 (Retroactive)
Renewable annually for a period of five (5) years until December 14, 2025,
NRC reserves the right to negotiate additional phases as required.
ESTIMATE OF POTENTIAL MARKET COST:
Estimated Contract Value: $177,725.00 CAD + tax

Suppliers who believe that they are fully qualified and ready to provide the goods or services described in this notice may submit a statement of qualifications to the contact person named in this notice by the closing date, which is also specified in the notice. The statement of qualifications must clearly demonstrate how the supplier intends to meet the requirements identified in the notice.
