Via this call for tenders, the AMF wishes to select a TENDERER for the acquisition and implementation of an Electronic Evidence and Litigation Support System (hereinafter the “SOLUTION”). The AMF requires that TENDERERS offer a SOLUTION that satisfies an EDRM framework.
In connection with the enforcement of laws and regulations in Québec, the AMF carries out inspections and investigations and prosecutes violations and offences under the financial sector legislation it administers. The eDiscovery project will allow the AMF to optimize its processes, from data collection and analysis to disclosure of information and, when necessary, presentation of that information before administrative or judicial bodies.
The principal reference framework for the administration of electronic evidence at the AMF is the EDRM model, which is the authority in the field. It sets out the various phases of eDiscovery—from initiation of the investigation to the presentation of evidence before the administrative or judicial body.
Moreover, the ever increasing volume and proportion of electronic documents requires the integration and use of specific technological tools. Among other things, the eDiscovery project will allow the AMF to optimize it business processes (investigations and prosecutions), strengthen the chain of custody, ensure the continued integrity of electronic evidence, take advantage of analysis tools, disclose evidence and standardize the AMF’s practices.
