PROJECT BACKGROUND

In October of 2018, the Government of Canada introduced Bill C-65, which aims to modernize the Canada Labour Code to protect employees from harassment and violence in federal workplaces, including the federally regulated private sector, the federal public service and parliamentary workplaces. There are three main elements to Bill C-65: the prevention of incidents, a timely and effective response to incidents, and support for affected employees. Bill C-65 modified the Canada Labour Code and introduced the Workplace Harassment and Violence Prevention Regulations, which entered into force in January 2021. Federally regulated workplaces now need to comply with the changes introduced through this legislation.

In the wake of the amendments to the Canada Labour Code, Trucking HR Canada is committed to supporting trucking and logistics employers in adjusting to and implementing these new requirements. Our organization has developed a comprehensive toolkit of employer resources, as well as a suite of industry-specific online and in-person anti-harassment and violence training courses. Our objectives are to support employer compliance with the Workplace Harassment and Violence Prevention Regulations, with a view to reducing/eliminating incidents in these federally regulated workplaces.

This project is funded in part by the government of Canada’s Workplace Harassment and Violence Prevention Fund.

Overall Project Overview

1) Improve understanding among employers and workers about the requirements to eliminate harassment and violence in the workplace and how they can be prevented.

2) Build a common understanding of the definition, nature, incidence and patterns of workplace violence and harassment in the Canadian trucking sector, including variations among different geographic regions of Canada.

3) Study best practises and experiences, both in Canada and internationally of anti-violence and anti-harassment training programs.

4) Create tools, resources and training modules that provide management and workers with information required to create safer workplaces with reduced incidences of harassment and violence.

5) Develop tools for monitoring changes to the performance of the trucking sector in reducing harassment and violence over time.

6) Develop a long-term strategy and mechanism to review and update the training program over time.

SCOPE OF WORK

Trucking HR Canada is soliciting Proposals from qualified professionals possessing appropriate education, training and experience in occupational health and safety to complete a series of guidance documents that will outline methodologies for the assessment of risks of workplace harassment and violence, as informed by requirements in the Workplace Harassment and Violence Prevention Regulations (the Regulations). Education, training and experience in the area of human resources is considered to be a strong asset.

As part of their obligations under the Regulations and the Canada Labour Code, employers and their applicable health and safety partner must jointly identify the risk factors, internal and external to the workplace that contribute to harassment and violence in the workplace, taking into account:

The culture, conditions, activities and organizational structure of the workplace;
Circumstances external to the workplace, such as family violence, that could give rise to harassment and violence in the workplace;

Any reports, records and data that are related to harassment and violence in the workplace;
The physical design of the workplace; and
The measures that are in place to protect psychological health and safety in the workplace.

The consultant must be able to identify and critically evaluate risks of harassment and violence that are specific to occupations within the trucking and logistics sector, as informed by the regulatory framework outline above. In response to identified risks, the consultant is required to write out detailed guidelines and generate work procedures consistent with occupational health and safety requirements under applicable federal legislation (Canada Labour Code and the Regulations). As part of this task, the consultant will provide detailed descriptions of specific areas of risk and propose recommendations on applicable control options; sharing health and safety industry trends and best practices. These recommendations will assist in providing guidelines that can help mitigate the risk of harassment and violence in the workplace, including the risk of domestic and/or family violence.

The final outputs will leverage and complement Trucking HR Canada materials and be used to inform and/or support Health and Safety programs at the enterprise level. Outputs will help ensure that Canadian trucking and logistics employers are able to execute workplace risk assessments that are compliant with the Workplace Harassment and Violence Prevention Regulations and all applicable federal legislation; thereby strengthening the capacity of trucking and logistics employers to reduce risks and improve response management at the enterprise level.

The scope of the services that may be requested are based on the following description as an outline. Note that specific duties and tasks (including some that may not be listed here) may be added or changed with consultation and agreement.

Required Qualifications

The candidate will:

Posses education, training and experience in occupation health and safety and/or human resources;
Have a proven track record, spanning at least 5 years, in providing services in occupational health and safety and/or HR;
Must be legally registered in and must have legal right to work in Canada.

Preference may be given to candidates with knowledge of, and experience in the trucking and logistics sector.
Scope of Services

The consultant will render the following services during the term of this contract:
Services:

A. Review existing Trucking HR Canada materials with the aim of developing an awareness of sector needs in the area of risk assessments for workplace harassment and violence
B. Develop detailed descriptions of the 5 areas of risks described in the Workplace Harassment and Violence Prevention Regulations, offering specific technical guidance, work procedures on how risks in each area can be assessed, and recommendations on applicable control options.
C. Produce a workplace harassment and violence assessment grid/framework that can be used by sector employers as a tool to guide and inform the analysis of workplace harassment and violence risks at the enterprise level.

3.1 PROJECT REPORTING

At the project outset, the consultant will be required to submit a detailed workplan that includes a bi-weekly progress report based on the approved workplan, budget, cost, variance analysis and risk monitoring (assessment, impact and probability) and other reporting as needed to fulfil the THRC contract reporting needs to the federal Labour Program.

4.0        BUDGET

Our proposed budget for consulting fees will be determined following further consultation with the selected Consultant.

Any and all costs associated with this submission to Trucking HR Canada are the responsibility of the consultant and will not be reimbursed.

All bid submissions need to include a breakdown of all fees, expenses, and applicable taxes. Trucking HR Canada also requires bidders to submit per diem rates and level of effort of all proposed resources.
5.0        PROPOSAL SPECIFICATIONS

We require all bidders to submit one (1) electronic submission of their proposal that includes a clear explanation of the bidder’s ability to complete the project and experience in undertaking similar projects. Proposals will be evaluated based on the consultant’s understanding of the project as well as their experience.
5.1        Company Profile

Here’s what we need: company background outlining your experience in similar projects; three (3) reference projects (including references) of similar scope which highlight the approach used.
5.2        Experience of the Company and Team

The proposal should clearly outline the proposed project team, their roles and responsibilities in this project, and include the names and summary of qualifications of all primary resources allocated to this project. The bidder should also provide the names and resumes of any sub-contractors who will be considered as backup resources in the event that the primary resources are unable to work on this project.

If a subcontractor is used, it will be the responsibility of the consultant to ensure the subcontractor can deliver on time, on budget and to a level of quality that is acceptable to Trucking HR Canada. Should a subcontractor be unable to deliver, it will be the responsibility of the consultant to bear any and all costs associated with aligning the project with the defined time frames.
5.3        Approach

The bidders will be expected to provide a detailed breakdown of the approach that will be used to meet the project deliverables.
5.4        Evaluation Criteria

Bidders should demonstrate experience and skills consistent with the requirements specified above. We will consider the following:

Clear understanding of the project and subject matter;

Ability to identify barriers to success;

Proposed approach;

Budget details and total cost.

This RfP is only open to entities based in Canada.

Trucking HR Canada reserves the right not to award a contract based on the offer of services submitted.
5.5        Proposal Submission

Bidders must submit one (1) electronic copy of their submission. No fax copies will be accepted. Please note that submissions should not exceed 15 pages in length, including appendices.

7.0 Intellectual Property

Exclusive proprietary rights for all data, information, findings and reports obtained or generated as part of this contract and project, or sub-contracts herein belong to THRC.

APPENDIX A

EVALUATION CRITERIA FOR PROPOSAL ASSESSMENT AND CONTRACTOR SELECTION
PROPOSAL CONTENTS

Your proposal should contain:

1.           A clear statement of the objectives.

2.           Current CV or Resume.

Proof of successful implementation of training courses over the past 5 years, including three (3) references of parties who can speak to your experience in facilitating bilingual training sessions.

Narrative explaining your knowledge, training, experience and approach to the facilitation of training. The narrative should not exceed three pages double spaced 12pt font.

An invoicing schedule tied to project deliverables.

Any other information which will aid in the evaluation of the proposal.

CONTRACTOR SELECTION

The contractor will be selected on the basis of the assessed highest technical proposal. Proposals will be evaluated according to the criteria shown below.
