This Advance Contract Award Notice (ACAN) is a public notice indicating to the supplier community that Agriculture and Agri-Food Canada (AAFC) intends to award a service contract to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a Statement of Capabilities. If no supplier submits, a Statement of Capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in this ACAN, the Contracting Officer may then proceed with the award to the pre-identified supplier.
REQUIREMENT:
The Lethbridge Research & Development Centre in Lethbridge, Alberta requires Building Control System Maintenance to an existing Siemen’s Controls System. The system consists of a server which runs a Desigo Software program and a BLN/Ethernet Network which operates PMX and TEC Panels and Expansion Boards.
SERVICES REQUIRED:
The contractor will be required to provide :
a) On Call Service during ‘regular working hours’
b) On-site Maintenance Service which will include but is not limited to :
i) Custom programming and application services
ii) Software and hardware services
iii) Central system services and minor system upgrades
c) Emergency service outside ‘regular working hours’
d) Equipment installation and decommissioning
e) Panel Replacements
f) Technical Support
g) Training
Scheduled Maintenance:
a) Quarterly preventative maintenance(PM) visits
b) Quarterly data back-up and restore services
c) Quarterly network maintenance
d) Quarterly BACnet analysis license
e) Quarterly preventative maintenance for automation and software maintenance.
f) Annual – Fume hood calibration and testing.
CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES:
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
- Are an authorized dealer who are certified to maintain and repair Siemens Building Control Systems including access the proprietary software to perform upgrades and conduct the required programming that is required for replacing / troubleshooting / updating the control nodes/modules.
CONTRACT PERIOD: February 1, 2024 to January 31, 2025 with three (3) one (1) year option periods.
ESTIMATED VALUE: $630,000.00 (including GST) – Initial Contract Period and all options periods

SOLE SOURCE JUSTIFICATION:
Siemens Canada Limited owns the proprietary software / firmware and intellectual property of the computerized controlling aspect of the BMS (nodes/modules). No other companies can access or purchase the software upgrades or conduct the required programming language that Siemens uses for replacing / troubleshooting / updating the control nodes/modules.
Other companies can supply / replace physical operating parts of the Siemens BMS system; however, they cannot provide any type of work or parts that deal with the computerized control system of the BMS
The entire Building Management System was developed by the Siemens Corporation and they are the Original Equipment Manufacturer. This includes computer programming and related language. The software and firmware is only developed and available through Siemens Corporation. The entire Building Management System is built and programmed using Siemens software / firmware, intellectual property, and parts. Multiple versions cannot be managed with this hardware / software. There are other suppliers of this type of BMS but we would need to outfit the entire controls structure to their product and then sole-source to them. The cost to re-outfit our controls structure would be in the millions of dollars.
Government Contracts Regulations Exception and Limited Tendering Reason:
Section 6 (d) has been invoked for this procurement as only one supplier (person/firm) is capable of performing the Contract.
Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
ACAN NOTICE:
You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the Contracting Authority.
An ACAN allows departments and agencies to post a notice, for no less than 15 calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a "Statement of Capabilities" that meets the requirements set out in the ACAN, the Contracting Authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the Contracting Authority will proceed to a full tendering process.
Submission of Statement of Capabilities:
Suppliers who consider themselves fully qualified and available to provide the services described herein, may submit a Statement of Capabilities in writing, either via letter or email to the contact person identified in this notice, on or before the closing date of this notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The Solicitation Number, Name of Contracting Authority and closing date of the ACAN must appear within your Statement of Capabilities in block letters.
The Crown retains the right to negotiate with suppliers on any procurement.
