Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.
If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met.
Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board electronic bidding authorities.
If other potential suppliers submit statements of capabilities during the fifteen calendar days posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
Definition of Requirements
As per the Canada Labour Code (CLC) part II, associated Occupational Health and Safety (OHS) Regulations and the National Joint Council (NJC) OHS directive, it is mandatory to develop, implement and revise the OHS programs at all levels in the organization.
As per CLC Part IV, non-compliance to CLC Part II and associated regulation can expose the organization to administrative monetary penalties.
Transport Canada’s Corporate OHS Office is responsible for the sound delivery and management of incident and accident reports, workplaces inspections, risk assessments, safety procedures, audits; and correctives actions.
The contractor is required to work with Transport Canada to grant right of access to an integrated and modular Software as a Services (SaaS), Amazon Web Services cloud-based located in Canada, to support Transport Canada (TC) in the implementation and management of its Occupational Health and Safety (OHS) Programs for the following modules:
Hazardous Occurrences Incident Reports (HOIR) management
Risk analysis
Audits and inspections
Procedures (Lock-out Tag-out, Safe Work Procedure, etc.)
Corrective and preventive actions (CAPA).
This service shall include training on how to use the solution (for the “everyday user” as well as for “administrators”) as well as provide continuous client and technical support.
Modules must dialogue with each other as well as with other Transport Canada internal systems, to have a fully integrated solution providing real time data consolidated with Power Bi, with the capacity to generate reports of different formats like for the Labour Program and Worker Compensation Board for each province of Canada.
Criteria for Assessment of the Statement of Capabilities
The Contractor will be assessed based on capabilities to provide Software as a Services access and functionalities meeting Transport Canada needs to manage to OHS programs including security requirement to host Protected B information. The Contractor must carry out the following services:
Provide the necessary qualified personnel to support client in the development, implementation and continuous use of the SaaS. This includes internal (within the company) personnel who have an expertise in health and safety.
Create TC organizational hierarchy for the viewing of data at all levels of the organization in the SaaS.
Synchronize and integrate current TC’s systems with the SaaS including organizational hierarchy, staff list, workplaces, list of Workplace Health and Safety Committees (WHSC)’s co-chairs, etc. available on TIPS and Power-BI.
Establish role-based permissions to simplify management of authorized users.
Establish single sign-on (SSO) and log-less access, and integrating the SaaS with TC governance software.
Provide support in the process mapping including revision of current processes, identification of best practices and exploration of possible configurations that will optimize the management of TC’s OHS programs, data and practices.
Integrate personalized processes and other specific configurations according to TC’s OHS programs, data management and OHS practices within each module.
Provide, when needed and requested, the integration of any additional external compatible functionalities determined by TC’s OHS Office within the solution
Provide support in the reviewing, confirmation, and optimization of usage scenarios for data creation and use with a smaller group to adjust configuration before deployment at a larger scale.
Provide continuous access to the SaaS non-productive online environment for the solution (training, processes configuration, report generation tests)
Provide training to super users to ensure a quick and optimal deployment of the solution for all users.
Provide friendly-user modules and integrated online video trainings in both official languages
Provide continuous access to the SaaS (non-productive and productive environment) 24/7 from anywhere (online and offline) and any devices (laptop, tablet, android, apple, iOS).
Provide technical support and customer success management (personnel available through the course of contract)
Communicate new functionalities available on regular basis.
Provide access to the SaaS solution, and client and technical services in both official languages (French and English) at the minimum. Multilanguage is desirable.
Provide a single tenant cloud base integrated to Amazon Web Services for data integrity
Provide, if needed, an integrated permit to work management module within the solution
The contractor must be able to provide updated versions of the SaaS in alignment with Canada Labour Code Part II and associated OHS regulations requirements and best practices in OHS management.
The contractor must have the ISO27001 and the SOC II Type II certifications.
The contractor conducts the work in and is in Canada, host Protected B data in a platform layer from Government of Canada, in an Amazon Web Services Cloud, and meet all security requirements.
In addition to those general functionalities, the contractor must provide the following functionalities for each module. Each module must be able to dialogue in real time with other one to allow Transport Canada to have an integrated OHS management system.
Risk analysis
The functionalities shall include the possibility to:
Create and manage risks inventory for jobs, tasks, and machines.
Share risks with non-users through reports or dynamic links.
Assess the risk level of individuals to prioritize mitigation actions.
Determine safety measures for individual risks and calculate the residual risk level.
View inspection results in real time directly in the software.
Visualize data through integrated dashboards.
Complete audit history for each risk profile.
Dialogue with other modules to create, for example, required corrective and preventive actions
Hazardous Occurrences Incidents Report (HOIR)
The functionalities shall include the possibility to:
Reporting event from multiple interfaces (mobile, web and offline)
Investigate the facts of the events and taking of testimonies.
Analyze immediate and root causes of events.
Determine safety measures for each cause.
Check the course of the TC's events through the history of individual events.
Track the progress of events through custom workflows.
Send notifications to staff of events and assignments.
Customize and populate reports to Labour Program and Worker Compensation Boards in each province.
View events in real time directly in the SaaS
Visualize data via integrated dashboards or connect to TC’s PowerBI platform.
Dialogue with other modules to create, for example, required corrective and preventive actions
Audit and inspection
The functionalities shall include the possibility to:
Collect audit and inspection observation points in both official languages and through online or offline mobile interfaces;
View inspection and audit results in real time directly in the SaaS;
Integrate inspection data into TC’s Power BI platform;
Dialogue with other modules to create, for example, required corrective and preventive actions.
Procedures
The functionalities shall include the possibility to:
Manage procedure templates for different types of procedures (LOTO, THA, SWP, etc.)
Create a reference list to standardize the writing of procedures
Create a list of energy isolating devices to be used in multiple procedures simultaneously.
Complete history of checks performed for each procedure.
Complete usage history for each procedure.
Automated update of all relevant procedures.
Provide a step-by-step guidance for implementing controls.
Provide tracking of implementation status of the controls.
Dialogue with other modules to create, for example, required corrective and preventive actions
Corrective and preventive actions (CAPA)
The functionalities shall include the possibility to:
Gather CAPA from events, non-compliance, initiatives, etc. in centralized place.
Perform follow-ups of the CAPA’s progress through a personalized workflow.
Check TC’s CAPA process through the individual CAPA history.
Notify staff of important CAPA-related actions.
Link individual CAPA to multiple sources.
Dialogue with other modules to update, for example, HOIR reports.
Data management and report production
The functionalities shall include the possibility to:
Visualize data in integrated dashboards or connect to TC’s Power BI platform
Extract data in different formats (like Excel, PDF, links)
Generate reports to the Labour Program and Workers Compensation Board for the designated province applicable for the event.
Justification for Pre-Identified Supplier
The proposed supplier is the only known contractor that meets the above requirements.
Exclusions and/or Limited Tendering Reasons
The contract is proposed under the Government Contracting Regulations, Section 6 (d) that states “only one person or firm is capable of performing the contract”
Contract Period
The proposed contract period will be from date of award of contract to March 31, 2028 with up to five (5) option years.
Estimated Cost
The estimated maximum value of the proposed contract is $2.771.973 CAD including applicable taxes.

Suppliers’ Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and is not to be construed as a competitive solicitation. Your written response must provide sufficient evidence (e.g. specifications, technical data, drawings, or any other proof) that clearly demonstrates that your product or service is capable of fulfilling this requirement.
Suppliers that have submitted a response will be notified in writing of TC’s decision to continue with the non-competitive procurement or to compete for the requirement
