To provide legal guidance, analysis and subject matter expertise with respect to a three-year project described as follows:
The project will support mining and exploration companies to increase their knowledge of, and address sexual harassment in the workplace. Public legal education and information (PLEI) on workplace sexual harassment will be developed and disseminated to employers, unions and employees. The project will also work with the mining industry to build capacity within the sector to support strategic and collaborative sector-wide measures to address sexual harassment and create inclusive and safe workplaces.
In order to ensure that the content of PLEI is correct, appropriate and helpful to employers, employees and unions working to address sexual harassment/violence in the mining sector, the Legal Consultant will provide legal expertise, guidance, analysis, review and advice with respect to:
- A research report, developed by MiHR, analysing:
- Federal, provincial, interprovincial legislation related to sexual harassment as it applies to the sector.
- Relevant recent government commissions, inquiries, task forces and investigations recommending measures for addressing sexual harassment, accounting for sexual and gender diversity and intersectionality across groups in general, and with respect to Indigenous women (such as Reclaiming Power and Place: The Final Report of the National Inquiry into Missing and Murdered Indigenous Women and Girls).
- Existing codes of conduct, sexual harassment/violence policies and procedures among mining & exploration companies, using a gender-based analysis plus framework.
- Effective policy/procedure mechanisms used in a related sector, such as oil and gas
- The creation of an overview of current legislative frameworks related to workplace sexual harassment/violence to which companies participating in the Canadian mining sector must comply (eg. a chart, infographic, venn diagram).
- The creation of PLEI materials suitable for employers, employees, unions and related stakeholders in the mining and minerals sector.
