What is an ACAN:
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, bysubmitting a statement of capabilities. If no supplier submits a statement of capabilities thatmeets the requirements set out in the ACAN, on or before the closing date stated for in the ACAN, the contracting officer may then proceed with the award of a contract.
2.Definition of requirement:
Shared Services Canada (SSC) has a requirement for the procurement of a new telephone system including maintenance and support for the Canadian Coast Guard Situation Centre and Regional Operations Centre’s. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these goods and services to Komutel Inc. Komutel provides the full spectrum of services including hardware sales, installation and device activation, custom development, training and technical support necessary for the (proposed?) software solution.
This proposed requirement is linked to the Joint Rescue Coordination Centre (JRCC)’s procurement of the same Komutel software already in place at multiple locations. Compatibility and commonality with the existing JRCC equipment is necessary in order for the Canadian Coast Guards Situation Centre’s (SITCEN)’s and JCRCC’s to communicate and share information as well as allow SITEN to use software and features that have already been customized by Komutel for JRCC.
For this reason it is proposed that this requirement be directed to Komutel Inc., who is the only known firm capable of performing the contract and keeping the consistency with the JRCC Emergency Procedures Solution that is already in place.
Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.
The professional services are to be provided to the various locations noted in the Appendix A of the attached Statement of Work (Annex A).
3. Government Contracts Regulations Exception and Limited Tendering Reason:
It is proposed that a contract be directed to Komutel Inc. for the supply of goods and professional services for installation work and training. This requirement is directed to Komutel Inc. in accordance with exception Section 6 (d) of the Government Contracts Regulations that states that only one person or firm is capable of performing this contract.
4. Period of the proposed contract and required delivery:
This contract is to be awarded on or before March 1, 2016, with delivery of services to commence immediately upon notification of contract award. The initial contract period shall start on or before March 1, 2016, for a 1 year initial period with 2 one year options.
5. Cost estimate of the proposed contract:
The Estimated cost of this contract is $675,000.00 (including taxes).

7. Suppliers' right to submit a statement of capabilities:
Suppliers who consider themselvesfully qualified and available to provide the services described herein, may submit a Statement of Capabilities in writing to the contact person identified below on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets theadvertised requirements.
Minimum Essential Requirements : Any interested supplier must demonstrate by way of a Statement of Capabilities that it can fulfill the requirements of the Statement of Work and the following requirements in order to be able to carry out the work:
A minimum of 4 years of experience in the delivery of telecommunications solutions within the last 10 years;
If a potential supplier submits a statement of capabilities during the posting period that meetsthe requirements set out in this ACAN, the government will proceed to a full tendering process oneither the government's electronic tendering system or through traditional means in order toaward the contract.
If no other supplier submits on or before the closing date a statement of capabilities meeting therequirements set out in this ACAN, a contract will be awarded to the pre-selected supplier.
8. Security requirement:
This solicitation contains a requirement for vendor and personnel security screening at a level of “Reliability”.

NSE Invocation : SSC has invoked the National security Exception (NSE) through an exchange of letters between Assistant Deputy Minister’s (ADMs) for all requirements “related to the Government of Canada’s electronic mail (email), network, and data centre infrastructure, systems and services”. “On May 28, 2012, the Government of Canada announced on the Government Electronic Tendering Service that it had invoked the National Security Exception under the trade agreements in respect of procurements related to email, networks and data centres for Shared Services Canada. As a result, this requirement is subject to the National Security Exception.”
