Article 513 : Appel d’offres limité
1. Sous réserve des paragraphes 2 et 3, et à condition qu’elle n’utilise pasla présente disposition dans le but d’éviter la concurrence entre lesfournisseurs ou d’une manière qui établit une discrimination à l’égard desfournisseurs de toute autre Partie ou protège ses propres fournisseurs,une entité contractante peut recourir à l’appel d’offres limité dans lescirconstances suivantes :

c) pour des livraisons additionnelles à assurer par le fournisseur deproduits ou de services initial qui n’étaient pas incluses dans le marchéinitial dans les cas où un changement de fournisseur pour ces produits ouservices additionnels :
i) d’une part, n’est pas possible pour des raisons économiques outechniques telles des conditions d’interchangeabilité ou d’interopérabilitéavec des matériels, logiciels, services ou installations existants qui ont faitl’objet du marché initial,
ii) d’autre part, causerait des inconvénients importants à l’entitécontractante ou entraînerait pour elle une duplication substantielle descoûts;

Article 513: Limited Tendering
1. Subject to paragraphs 2 and 3, and provided that it does not use thisprovision for the purpose of avoiding competition among suppliers or in amanner that discriminates against suppliers of any other Party or protectsits own suppliers, a procuring entity may use limited tendering in thefollowing circumstances:
(...)
(c) for additional deliveries by the original supplier of goods or servicesthat were not included in the initial procurement, if a change of supplier forsuch additional goods or services:
(i) cannot be made for economic or technical reasons such asrequirements of interchangeability or interoperability with existingequipment, software, services, or installations procured under the initialprocurement; and
(ii) would cause signifi cant inconvenience or substantial duplication ofcosts for the procuring entity;
